Enoch Burke Returned to Jail for Breaching Court Orders

Enoch Burke, a controversial figure known for his legal troubles, has once again found himself behind bars after breaching a court order. This time, the High Court in Ireland ordered Mr. Burke’s immediate return to Mountjoy Prison following his release just days ago.

The Breach and Legal Proceedings

Enoch Burke was arrested outside Wilson’s Hospital School on Monday morning, less than a week after his release from prison. The school had filed an application with the High Court seeking to have Mr. Burke brought back into custody due to a perceived breach of a court order prohibiting him from trespassing at the premises.

Burke appeared before Mr Justice Brian Cregan shortly after 11 am, where he was informed of his immediate committal to Mountjoy Prison. The judge found Mr. Burke in clear breach of the court order and ordered his return to prison without delay.

In a hearing last Friday, an order had been made for Mr. Burke’s arrest.

Details from the Affidavit

The case was bolstered by an affidavit submitted by Rosemary Mallon on behalf of Wilson’s Hospital School. The affidavit detailed that following his release on Wednesday, Mr. Burke had trespassed at the school premises twice, on Thursday and Friday mornings, attempting to approach the building despite being stopped by a security guard.

Cunningham, the principal of Wilson’s Hospital School, stated in the affidavit that he had initiated an interview with The Sunday Independent “in a misguided attempt” to provide the school some good publicity. However, he later realized it was inappropriate and backtracked during his appearance before the court.

Statements from Enoch Burke

During the hearing, Mr. Burke expressed astonishment at the sequence of events leading up to his arrest. He claimed that he had made no secret about returning to Wilson’s Hospital School and accused the courts of working with the government in denying him his constitutional rights.

However, these assertions were dismissed by Mr Justice Cregan as “nonsense.”

Mr. Burke also alleged that the affidavit submitted by the school was sworn “seemingly in haste” and accused the principal of backtracking during the hearing due to legal pressure. Despite these allegations, Mr Justice Cregan was satisfied that Mr. Burke had again trespassed on school grounds in a “flagrant breach of the court order.”

The Immediate Consequences

As a result of the High Court’s ruling, Enoch Burke was immediately escorted from the court by Gardaí (Irish police) to a waiting patrol car and returned to Mountjoy Prison. Mr. Burke hugged his father and brother before being taken away.
